1. Right of Withdrawal for Private Consumers

Pursuant to Italian Legislative Decree No. 206 of 6 September 2005, the Consumer Code, the right of withdrawal applies exclusively to customers qualifying as consumers, namely:

a natural person who purchases goods for purposes unrelated to any entrepreneurial, commercial, craft or professional activity they may carry out.

Therefore, any customer making a purchase without indicating a VAT number has the right to withdraw from the purchase contract within 14 (fourteen) calendar days from the date of receipt of the goods, without having to provide any reason and without any penalty, as provided for by Articles 52 and following of the Consumer Code.

To exercise this right, the Customer must send written notice to FEVI srl unipersonale within the above-mentioned term, using one of the following channels:

2. Information to Be Included in the Return / Withdrawal Request

The withdrawal notice must include:

• Customer’s name and surname

• Full address

• Order number or transport document reference

• Date of purchase and date of receipt of the goods

• Description of the product subject to withdrawal

• Bank details, IBAN, for the refund, where necessary

Upon receipt of the notice, FEVI srl unipersonale will send the return instructions by email.

3. Return Conditions

The product must be returned:

• intact and complete with all its parts and accessories;

• in its original packaging;

• unused, clean and free from damage or signs of wear.

The right of withdrawal applies only to the product in its entirety, and not to individual parts or components.

Return shipping costs shall be borne by the customer.

The shipment remains under the customer’s responsibility until receipt at the FEVI warehouse.

Any damage, signs of use or tampering will result in a reduction of the refund, proportionate to the actual decrease in the value of the goods, up to the amount required to restore the packaging or the product.

The refund will be issued within 30 days from receipt of the compliant goods, using the same payment method used for the purchase or by bank transfer.

4. Exclusion of the Right of Withdrawal

The right of withdrawal is excluded in the following cases, pursuant to Article 59 of the Consumer Code:

• customised products or products manufactured according to the customer’s specific request;

• sealed goods that are not suitable for return for hygiene or health protection reasons, where they have been opened after delivery;

• products that are damaged, used or not intact.

5. Purchases with VAT Number and Professional Customers

Purchases made by professional customers or companies, namely with indication of a VAT number, do not fall within the scope of application of the Consumer Code, as provided for by Article 3, paragraph 1, letter a) of Italian Legislative Decree No. 206/2005.

Therefore, the 14-day right of withdrawal reserved for private consumers does not apply.

However, FEVI srl unipersonale may, at its sole discretion, evaluate any return or replacement requests submitted by business customers on a commercial and not legal basis, provided that:

• the request is justified and submitted within 24 hours from receipt of the goods;

• the product is intact, unused and in its original packaging;

• shipping costs are entirely borne by the customer;

• the return has been previously authorised in writing by the FEVI Sales Office or Administration Department.

Any refunds or replacements will be managed only after a technical inspection of the returned material.

6. Defective or Non-Conforming Products

In the event of defective goods or goods not conforming to the order, the customer, whether private or business customer, must report the issue within 7 days from delivery by writing to info@fevi.it.

FEVI srl unipersonale provvederà alla verifica e, se accertato il difetto, a riparazione, sostituzione o rimborso in base alle condizioni previste dagli articoli 128 e seguenti del Codice del Consumo e/o dalle garanzie commerciali applicabili.
